BidStacker is an AI-powered platform that helps small businesses find, evaluate, and respond to government contracting opportunities. The Service includes RFP search, AI-generated proposal content, compliance checking, and match scoring.

3. Account Registration

You must provide accurate, current, and complete information during registration. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

4. Success-Based Pricing

BidStacker operates on a success-based fee model. You will only be charged a percentage of the contract value when you are awarded a government contract that was facilitated through the platform. Specific fee rates are disclosed on our pricing page and may vary by contract size.

5. AI-Generated Content

Proposal content generated by BidStacker's AI is provided as a starting draft. You are responsible for reviewing, editing, and verifying all AI-generated content before submission to any government entity. BidStacker does not guarantee the accuracy, compliance, or success of AI-generated proposals.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using BidStacker, you consent to the collection and use of your information as described in the Privacy Policy.

7. Intellectual Property

Content you create on the platform, including proposals, is owned by you. BidStacker retains the right to use anonymized, aggregate data to improve the Service. The BidStacker platform, including its AI models, algorithms, and software, is the intellectual property of BidStacker Inc.

8. Limitation of Liability

BidStacker provides the Service "as is" and makes no warranties regarding the accuracy of RFP data, match scores, or AI-generated content. In no event shall BidStacker be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service.

9. Termination

Either party may terminate the agreement at any time. Upon termination, your access to the Service will cease, but any pending success-based fees for awarded contracts will remain payable.
